Terms of Service

These terms govern your use of nimbox.app and related services operated by NimboX Labs Inc., a Delaware C-Corporation.

Pre-launch notice. NimboX is in pre-launch development. The platform is not yet generally available, no real-money trading occurs through nimbox.app directly, and no consumer accounts have been onboarded. These terms will be replaced with a formal version on or before public launch. By accessing the site you agree to the current terms.

1. What NimboX is

NimboX is a consumer software platform that aggregates global weather forecast data and surfaces relevant CFTC-regulated event contracts to users planning weather-dependent travel and activities. We are an information and discovery layer.

We are not an exchange. Trading of event contracts occurs on third-party CFTC-regulated Designated Contract Markets (DCMs), including Kalshi.
We do not custody customer funds. Funds and positions are held by the regulated exchange.
We do not accept wagers. Event contracts are derivatives regulated by the Commodity Futures Trading Commission, not bets or gambling.
We earn revenue through subscriptions, affiliate commissions from regulated exchange partners, and data licensing.

2. Eligibility

You must be at least 18 years old (21 in some jurisdictions) and a resident of a jurisdiction where regulated event contract trading on our partner exchanges is permitted. Trading on partner exchanges may not be available in all U.S. states. You are responsible for determining your own eligibility.

3. Account and access

An account on nimbox.app is free. To trade event contracts, you must complete account verification with our regulated exchange partner (Kalshi at launch), subject to their eligibility, KYC, and AML requirements. Your trading account is governed by the exchange's terms, not ours.

4. No investment advice

Information on NimboX — including forecasts, market prices, Nimbo Scores, expert commentary, and trip recommendations — is for informational purposes only. We do not provide investment, financial, legal, tax, or trading advice. Past performance does not guarantee future results. Forecast accuracy is probabilistic and subject to inherent uncertainty.

5. Risk disclosure

Event contract trading involves substantial risk of loss. You can lose all or more than your initial position. Weather is inherently uncertain. Forecasts are subject to revision. Markets can move against your position rapidly. Do not trade with funds you cannot afford to lose. Consider hedging only as part of a broader risk-management strategy aligned with your financial situation.

6. Nimbo Scores

Nimbo Scores are an independent reliability rating system produced by NimboX Labs. The methodology is published, the inputs are public, and the algorithm is auditable. Destinations cannot pay to improve their rating. Nimbo Scores reflect probabilistic estimates of weather reliability and do not guarantee specific outcomes.

7. Acceptable use

You agree not to:

Use NimboX for any unlawful purpose or in violation of any applicable law
Reverse-engineer, scrape, or systematically extract data from the site beyond reasonable personal use
Misrepresent your identity, eligibility, or jurisdiction
Manipulate or attempt to manipulate prices or markets on partner exchanges
Use NimboX data to operate a competing rating, scoring, or forecasting service without a license

8. Intellectual property

NimboX, Nimbo Scores, and the bolt-in-roundel logo mark are trademarks of NimboX Labs Inc. (registrations pending). Site content, methodology, and software are owned by NimboX Labs and licensed to you only for personal, non-commercial use. Commercial licensing is available — contact partnerships@nimbox.app.

9. Disclaimers and limitation of liability

The site is provided "as is." We make no warranty regarding accuracy, availability, or fitness for any particular purpose. To the maximum extent permitted by law, NimboX Labs Inc. and its officers, directors, and employees are not liable for any indirect, incidental, consequential, or special damages arising from use of the site, including but not limited to trading losses, missed opportunities, forecast errors, or interruptions of service. Total aggregate liability shall not exceed amounts you have paid us in the prior twelve months, or $100, whichever is greater.

10. Changes to these terms

We may update these terms periodically. Material changes will be posted on this page with a new effective date. Continued use of the site after a change constitutes acceptance.

11. Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Delaware.
